1.About us and these terms
This website is run by Light of Hope Foundation Inc. (“the Foundation”, “we” or “us”), a registered charity based in Caulfield South, Victoria.
These terms apply when you use this website, including our courses library, printable handouts and templates, and our contact and donation pages. By using the website, you agree to them. If you don’t agree, please don’t use the website.
Please read them together with our privacy policy.
2.The short version
These terms are here to keep things clear and fair for everyone. In short:
- Use our materials to learn and to support your community, not to make money.
- Treat the website, and the people behind it, with respect.
- Our information is general. It isn’t a substitute for help from a qualified professional who knows your situation.
- If something goes wrong, talk to us first.
This summary is here to help. The full terms below are what apply.
3.Not an emergency, health or crisis service
Light of Hope Foundation offers community education, cultural activities and programs that help people take part in community life. We don’t provide emergency, crisis, clinical or treatment services, and we are not an NDIS provider.
If you or someone else is in immediate danger in Australia, call 000. If you need crisis support, call Lifeline on 13 11 14. You can also speak with your doctor or another trusted health professional about ongoing support.
Our email and phone may not be answered straight away, so please don’t use them to ask for urgent help. For more options, visit Need help now.
4.General information only
Everything on this website, including our courses, handouts and templates, is general information for community education. It doesn’t take your personal circumstances into account.
It is not medical, psychological, legal, financial or nutritional advice. It is not food safety training, and it doesn’t certify anyone in food safety.
Please think about whether information suits your situation before acting on it, and get advice from a qualified professional when you need it.
5.Courses and printable resources
Our online courses are theory and discussion only.
These courses are not accredited or nationally recognised training. They don’t lead to a qualification, or to a food handler or food safety supervisor certificate.
We talk, teach and share ideas. Participants don’t prepare food or use garden tools or kitchen equipment in these courses.
If you decide to put ideas from a course or resource into practice, for example in a kitchen, garden or community group, you are responsible for following current official guidance, the laws that apply to you, and advice from qualified professionals.
Allergies, swallowing concerns, prescribed diets and other health needs require advice from the relevant qualified practitioner.
6.In-person programs and events
Taking part in our programs and events is voluntary. Joining in and sharing are always your choice. No one has to discuss personal history or trauma to take part.
Some programs have their own registration forms, participation terms or safety instructions. Where they apply, we’ll give them to you before you take part, and they apply alongside these terms.
To help keep everyone safe, please follow reasonable instructions from the people running an activity, and let us know about any allergy, access or other needs that may affect how you take part.
7.Using our content
You’re welcome to use the content on this website, including course material and the handouts and templates on our resources page, for your own personal use and for non-commercial community education.
You may print copies for those purposes, including to hand out in a non-commercial community education setting, as long as you:
- credit Light of Hope Foundation as the source
- don’t change the content or present it as your own
- keep any copyright, licence or attribution notices
- don’t sell it, charge for it, or include it in anything that is sold
For anything else, such as commercial use, adapting our materials or publishing them elsewhere, please ask us first through our contact page.
Some material on the website belongs to other people and is used under licence. Their conditions may limit how it can be used (see Our intellectual property).
8.Our intellectual property
The website and its content, including text, course material, handouts, templates, photos, graphics and design, belong to the Foundation or are used under licence from their owners. They are protected by copyright and other laws.
Our website footer carries this notice, with the current year: “Cultural Heritage and Creative Education Collection. © [year] All rights reserved. Selected materials used under licence. Third-party use requires permission.”
In practice, this means that apart from the uses allowed in Using our content, you need our written permission to use our materials. Material we use under licence may also need its owner’s permission.
Our name and logo may not be used without our written permission, including in any way that suggests we endorse or are connected with you, your organisation or your product.
If you think something on our website infringes your rights, please contact us and we’ll look into it promptly.
9.Using the website responsibly
When you use this website, please don’t:
- break any law, or help someone else to
- try to get unauthorised access to the website, our systems or anyone’s information
- introduce viruses or harmful code, or try to overload or disrupt the website
- copy content in bulk by automated means, such as scraping, or use it to train artificial intelligence tools, without our permission
- send us anything unlawful, threatening, abusive, defamatory or discriminatory, or anything that invades someone’s privacy
- pretend to be someone else, or misrepresent your connection with us
10.Material you share with us
Through our programs, you may choose to share stories, photos, recipes, recordings or cultural material with us. Sharing is always optional.
When you share material with us:
- You keep ownership of it.
- You confirm that it’s yours to share, or that you have permission from anyone who owns it or appears in it, and that sharing it doesn’t break any law or anyone else’s rights.
- You give us free, non-exclusive permission (a licence) to use, copy and display it only for the purpose you agreed to when you shared it, such as a program display, our website or a course handout. This includes small changes needed to fit a format, such as cropping or resizing.
- We’ll credit you in the way you choose, or not at all if you prefer.
- If it has cultural significance to your family or community, tell us about any conditions on its use, and we’ll respect them.
You can withdraw your permission for future use at any time by contacting us. We’ll stop new uses and remove the material from our website within a reasonable time. We can’t recall copies already printed or shared, but we won’t include the material in anything new.
Our privacy policy explains how we handle personal information in what you share.
11.Donations
Donations made through this website are processed by PayPal, on a page PayPal hosts. PayPal’s user agreement (opens in a new tab) and privacy statement (opens in a new tab) apply to your payment. We don’t see your card or bank details.
PayPal may share with us your name, email address, the amount you gave and any note you add, so we can record your donation.
- Receipts: if you need a receipt for your donation, please contact us.
- Tax: not every registered charity can receive tax-deductible donations. Whether a donation is tax deductible depends on the charity’s endorsement by the Australian Taxation Office. You can check any charity’s details on the ACNC Charity Register (opens in a new tab), or ask us.
- Mistakes and refunds: if you think a donation was made in error, for example the wrong amount, please contact us as soon as you can and we’ll look into it with you. This doesn’t limit any rights you have under PayPal’s terms or the law.
12.Links to other websites
Our website links to other sites, such as government websites, Lifeline, PayPal, Google Maps and Volunteering Victoria. We link to them because we think they may help, but we don’t control them and aren’t responsible for their content, availability or privacy practices.
A link doesn’t mean we endorse the site or the organisation behind it. Please check the terms and privacy policy of any site you visit.
13.Accuracy, availability and changes to the website
We take care to keep the website accurate and up to date, but information can change and mistakes can happen. If you notice an error, please let us know.
We may update, add or remove content, courses or resources, and the website may sometimes be unavailable, for example during maintenance. We’ll try to keep disruption to a minimum.
Details of programs and events, such as dates and places, can change. Please check with us before making plans that depend on them.
14.Your rights under the Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or changed.
For example, where the Australian Consumer Law gives you a consumer guarantee, such as that services will be provided with due care and skill, these terms don’t take it away.
The Australian Consumer Law is in Schedule 2 to the Competition and Consumer Act 2010 (Cth). Every limit on our liability in these terms applies only to the extent the law allows.
15.Disclaimers and limits on our liability
To the extent permitted by law:
- we provide the website, courses and resources “as is”, and we don’t make promises about them beyond those the law requires
- we take reasonable care, but we don’t promise the website will always be available or free of errors or viruses
- we are not responsible for loss or damage that results from relying on general information on this website instead of getting advice suited to your situation
- we are not responsible for third-party websites or services we link to, including PayPal, or for their content
- we are not responsible for loss or damage caused by events outside our reasonable control, such as internet or hosting outages
- we are not liable for any indirect loss that we could not reasonably have foreseen
Nothing in this section limits our responsibility for fraud or deliberate wrongdoing, or any liability that the law does not allow us to limit.
16.Indemnity
If you break these terms, or share material with us that you didn’t have the right to share, and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs from that claim, including reasonable legal costs.
This doesn’t apply to the extent that we caused or contributed to the loss. We’ll take reasonable steps to keep those losses and costs down.
17.Privacy
Our privacy policy explains how we collect, use, share and protect personal information, including through our contact form, programs and donations.
18.Suspending access for misuse
If we reasonably believe someone has seriously or repeatedly broken these terms, or is using the website in a way that could harm others, us or the website, we may take reasonable steps to stop it. This could include blocking access, removing material or reporting unlawful conduct to the authorities.
Any action we take will be in proportion to the problem. Where it’s appropriate and safe, we’ll explain why.
19.Changes to these terms
We may update these terms from time to time, for example when our website, programs or the law change. We’ll publish the updated terms on this page and change the “Last updated” date at the top.
If a change is significant, we’ll give reasonable notice on the website before it takes effect.
Changes won’t apply to anything that happened before they took effect, and won’t widen how we can use material you’ve already shared without your agreement.
If you don’t agree with a change, you can stop using the website, and you can ask us to stop future use of material you’ve shared.
20.Governing law
These terms are governed by the laws of Victoria, Australia, where the Foundation is based. Disputes about them can be heard by the courts of Victoria and the courts that can hear appeals from them.
If you have a concern, please contact us first. Most problems can be sorted out by talking.
21.Severability and waiver
- If any part of these terms is invalid or can’t be enforced, it will be read down as far as needed, or removed, and the rest of the terms will continue to apply.
- If we don’t enforce part of these terms straight away, we haven’t given up our right to rely on it later.
